In Scotland, a mortgage is a legal charge against your home, which remains even after the loan is entirely paid off. Only a solicitor can remove the charge from your title deeds. The timeline of a mortgage discharge is largely dictated by how quickly your lender and the Land Register process the paperwork. The process typically takes between 4 and 8 weeks to complete.
Some lenders use a digital system to sign/seal the discharge deed, which can take just a few days, while others still use paper-based processes that can take several weeks. If your property is on the modern Land Register, the signed deed can be processed in as little as 24 hours after it is submitted, but paper applications, or one that involves the older General Register of Sasines, may take slightly longer.
While it is not strictly necessary to discharge your mortgage immediately after paying off the loan, it is recommended to do so as soon as possible. Without this step, the property still technically appears as mortgaged to anyone looking at the public record.
