Personal injury claims
Not all accidents give rise to compensation claims. Our law operates on a fault-based system, meaning you must prove that someone else failed in their duty not to harm you, and that you suffered loss or injury as a result. Austin Lafferty’s lawyers will distil all the legal terminology so that you fully understand the various stages of a claim and how our experts are working hard on your behalf.
We use state-of-the-art case management systems and have access to leading medical and technical experts and QCs, to ensure your case progresses as smoothly as possible.
Types of claim
Each case requires specific evidence to prove negligence and demonstrate the impact on your life and finances.
What compensation can you claim?
- Solatium – Compensation for pain and suffering based on established legal precedents for your type of injury.
- Loss of earnings – Recovery of lost wages and, if necessary, future earnings if you remain unable to work.
- Out-of-pocket expenses – Reimbursement for medical travel, prescriptions, vehicle hire and damaged property.
- Care costs – Compensation for professional or family care required due to your injury.
- Loss of society and support – For families whose loved one has been killed, covering both emotional loss and financial support.
The claims process
Broadly speaking, you have three years from the incident or from when you reasonably became aware of your condition (such as after a stay in hospital) to make a claim. After this point, the legal deadline for filing a lawsuit has passed.
During the case, you must present evidence including medical reports, witness statements, wage confirmations and expense receipts. Medical evidence from your GP and relevant specialists is also essential for injury claims. Our personal injury solicitors will explain what is needed for your specific case and support you in compiling the relevant information.
Court cases typically take months or years to complete. If settled out of court, the opponent's insurer pays legal fees and outlays, though some costs may be deducted from your award. When cases proceed to court and you win, the losing party usually pays your costs. Your solicitor will explain all fee and financial arrangements at the outset and put everything you need to know in writing.
